Smoke nuisance and complaints

Smoke nuisance is the release of smoke which impacts on the use and enjoyment of a property. This can be from the use of an unauthorised appliance or fuel, or from a badly fitted or maintained stove or chimney.

If a neighbour installed or using a stove that is causing you problems when in use, we may be able to help.

Initially, we would advise that you contact the person responsible to see if a resolution can be found informally.  Often, they are simply unaware of the impact they are having. Where this is not possible, or the situation does not improve, the council can carry out an investigation into the nuisance.

Officers will visit your property to witness the impact and you may be asked to keep a diary of the events.

If the inspection shows that the smoke is interfering with the enjoyment of your home and is unreasonable, the person responsible will be asked to demonstrate they are complying with smoke control and fuel requirements and / or asked to take preventive measures to reduce the impact.
