Minor variation
A minor variation is required when changes are proposed to a licensed premises but these changes will not impact adversely on the licensing objectives.
A minor variation is a small variation which will not impact adversely on the licensing objectives and is therefore subject to a simplified variation process.
An application may not be made under this section to vary a premises licence so as to:
- Extend the period for which it has effect
- Vary substantially the premises to which it relates
- Specify an individual as the premises supervisor
- Add the supply of alcohol as an activity authorised by the licence
- Authorise:
- The supply of alcohol at any time between 11pm and 7am
- An increase in the amount of time on any day during which alcohol may be sold by retail or supplied
- Include the alternative licence condition referred to in section 41D(3) (see supply of alcohol from community premises)
Application evaluation process
Applications must be sent to the licensing authority for the area where the premises are located.
Applications must be in a specific format and be accompanied by:
- Any required fee
- The current premises licence or, if that is not possible, a statement outlining the reasons why the applicant has failed to provide the licence
- A plan of the premises (if the proposed minor variation involves any changes to the layout of the building)
When submitting your application to us, you must ensure that you take the following steps for it to progress:
- Advertise your application by displaying a public notice at the premises for 10 working days (starting with the day after you submit your application to us)
In considering an application for a minor variation, if the licensing authority has any doubt about the impact of the proposed variation on the licensing objectives, they must consult with the relevant responsible authorities.
Other people and responsible authorities then have ten working days in which to make Representations about the application to us (as the licensing authority).
Minor variation applications do not go before a Licensing Sub-Committee if an objection is received.

The application fee for a minor variation of a premises licence is £89.00

Will "tacit consent" apply?
Tacit consent does not apply to minor variation applications.
This is because the Licensing Act 2003 stipulates that, should an application not be determined within 15 working days of it being submitted then it is automatically rejected and the application fee must be returned.
Failed application redress

If you apply for a minor variation and your application is rejected, you will not be able to appeal. However, you can reapply using the full variation process.
